Access to the Website implies knowledge and acceptance of these Terms and Conditions, as well as being of legal age and of sound mind for the purpose of purchasing any of the products available on the Website.

Morfeohas no obligation to control and does not control the use thatUsersmake of the Website and, therefore, does not guarantee thatUserswill use the Website in accordance with the provisions of these Terms and Conditions, nor that they will make diligent and/or prudent use of it. Morfeois not obliged to verify and does not verify the identity ofUsers, nor the accuracy, validity, completeness, and/or authenticity of the data they provide.

Morfeoexcludes any liability for damages of any kind that may be due to the unlawful use of the Website byUsersor that may be due to the lack of truthfulness, validity, completeness, and/or authenticity of the information thatUsersprovide to otherUsersabout themselves and, in particular, but not exclusively, for damages of any kind that may be due to the impersonation of a third party by aUserin any kind of communication made through the Website.

Notwithstanding the foregoing,Morfeoreserves the right to limit, totally or partially, access to the Website to certainUsers, as well as to cancel, suspend, block, or remove certain types of content, through the use of appropriate technological tools, if it becomes aware that the activity or information stored is illegal or damages the property or rights of a third party. In this regard,Morfeomay establish the necessary filters to prevent illegal or harmful content from being posted on the network through the service.

Morfeoshall not be liable for any service interruptions, connection errors, lack of availability or deficiencies in Internet access service, nor for interruptions in the Internet network or for any other reason beyond its control.

Morfeois not responsible for any security errors that may occur or for any damage that may be caused tothe User'scomputer system (hardware and software), files, or documents stored therein as a result of:

Purchase Process

Usersmay purchase the products offered byMorfeothrough the Website by entering the requested information in the corresponding form on the Website's purchase gateway.Usersmust then follow all the steps in the purchase procedure indicated by the Website.

Likewise, once the purchase process has been completed, the Website's payment gateway will inform theUser via email of all the relevant characteristics of the product purchased. If theUserdoes not receive the confirmation email within twenty-four hours of completing the purchase, it will bethe User'sresponsibility to confirm the approval of the transaction withMorfeo.

The prices of the products offered on the Website include Value Added Tax (VAT) or other taxes that may be applicable and will always be expressed in euros (€).

Orders placed on theMorfeoWebsite will be governed by the prices offered for each product at the time the order is placed. The applicable prices will be those automatically published during the purchase process in the final stage thereof. TheUserwill always be informed of the final price of the purchase of a product prior to completing the purchase process.

 

Payment methods

TheUsermay make the payment by selecting one of the payment methods available on the Website (card payment, installment payment, bank transfer payment, PayPal payment). Some payment methods may incur a surcharge on the final price, in which case theUserwill be informed in advance on each occasion.

Specifically, theUsermust take the following into account:

El Usuario en el momento que realice la transferencia, deberá indicar en el concepto de la misma el número de pedido que le facilitará Morfeo al final del proceso de compra. El Usuario es consciente y acepta que el método de pago por transferencia puede implicar un retraso en la entrega del pedido ya que Morfeo no iniciará la preparación del envío hasta haber comprobado que el importe transferido coincide con el importe exacto del pedido. Morfeo no asumirá ningún tipo de coste por posibles comisiones bancarias que sean aplicables por lo que el Usuario deberá asumirá tales comisiones.
• Pago a plazos: el Usuario cuenta con la posibilidad de pagar a plazos el importe de un producto adquirido en el Sitio Web mediante el servicio ofrecido por la plataforma Aplazame (aplazame.com). Este es un servicio ajeno a Morfeo y Morfeo tan solo facilita su contratación a través del Sitio Web. Por lo tanto, el Usuario queda sujeto en todo momento al cumplimiento de las condiciones particulares de este servicio sin que Morfeo intervenga en la contratación ni mantenga responsabilidad alguna derivada de la contratación del mismo por parte del Usuario
• Pago mediante PayPal: el Usuario puede utilizar la plataforma de PayPal como pasarela de pago del importe del producto adquirido en el Sitio Web. Morfeo no cobrará ningún recargo extra por la utilización de este método de pago.

 

All payments made toMorfeowill result in an invoice being issued inthe User'sname according to the details provided during the contract process, which will be sent by email to the address provided by theUser.

Payment by phone using a credit card

Userscan pay by credit card viaMorfeo'scustomer service telephone line during the business hours specified on the Website. To proceed with the purchase,Usersmust provide their credit or debit card details to theMorfeoagent who will assist them during the call and who will enter the details into Banco Sabadell's secure payment gateway.

Through this payment method,Morfeoguarantees theUserthat it will never manipulate or store any data provided by theUserrelating to their person or their means of payment. The data provided is entered directly into the Banco Sabadell payment gateway.Morfeotherefore only carries out temporary and completely transparent processing, offering total transparency, security, and confidentiality tothe Userat all times.

 

Payment by phone using a credit card

The User has the option of paying by credit card through Morfeo's customer service line during specified business hours. To proceed with the purchase, the User must provide their credit or debit card details to the Morfeo agent, who will enter the details into the payment gateway.

Through this payment method, Morfeo guarantees the User that there is no manipulation or storage of any data provided by the user related to their person or their means of payment. The data provided is entered directly into the Banco Sabadell payment gateway. Morfeo therefore only carries out temporary and completely transparent processing, offering total transparency, security, and confidentiality to the User at all times.

 

 

Transportation and shipping of products

Transportation of products purchased through the Website is included in the price unless expressly stated otherwise prior to completion of the purchase process. The transportation service offered byMorfeodoes not include any assembly service for products purchased through the Website.

Products purchased before 3:00 p.m. will be delivered via the "Free 1-Day Delivery" service, which consists of delivery to theUser'saddress during the afternoon of the following day, except on weekends and holidays, when delivery will be made on the second day immediately following the last holiday.

However, theUsermust bear in mind that, althoughMorfeomakes every effort to ensure that the "Free 1-day delivery" service works correctly at all times, on occasions and for reasons beyondMorfeo's control, the order may be slightly delayed, but in no case for more than five business days.

In any case, ifMorfeofails to meet the specified delivery date by more than 5 business days, theUsermay choose to cancel the order andMorfeowill refund the purchase amount using the same method used during the purchase, as quickly as possible. Under no circumstances shallMorfeobe considered to be in breach of this clause when the order has been delayed atthe User'srequest or when theUsercould not be located at the address specified for delivery of the product or through the contact details provided by theUser.

TheUseris responsible for ensuring that the items purchased on the Website do not pose any accessibility problems at the specified delivery location, particularly in corridors, doorways, stairways, landings, etc. The transport service is not authorized to use any means of lifting that involves pulleys and/or ropes outside the delivery location. In the event that the items purchased do not fit through the regular access, all extraordinary expenses arising from cranes or platforms shall be borne solely and exclusively bythe User.

Warranty

So that you don't have to worry about anything, here's what our warranty covers Our range of mattresses is designed to be used on bases (upholstered, storage, adjustable, slatted, floor, etc.) that are capable of supporting the weight of the mattress and the person(s) using it. In other words, as long as you don't use it to catapult your partner, sibling, friend, or anyone else, you use it properly, and you keep it in a place where it won't deteriorate, you can rest easy with your mattress warranty.

What does your warranty cover?

The conditions to be taken into account are a base that supports the weight of the mattress evenly and with the same measurements as the mattress, and a maximum weight of 95 kg per person under normal temperature and humidity conditions, i.e., humidity between 50% and 70% and ambient temperature between 18 and 22 degrees. In general, the warranty covers any damage or malformation that is not the result of misuse of the mattress. Here are some details about the different cases:

• Clearly visible sagging on the top surface of the mattress.
• Any manufacturing defect in the cover (in this case, you must notify us within the first 14 days): torn cover, etc.

 

Return Policy

At Morfeo, we want our customers to have the best possible experience with our products. That's why we offer different return policies depending on the category of the product purchased. Below, we detail the conditions applicable to each type of product:

1. Mattresses – 100-Night Trial

• We offer arecommended minimum trial period of 30 nights and up to 100 nightstoensure that the mattress is right for you.

• If you decide to return it after this period, we will refund the full amount of the mattress.

• The mattress must be ingood condition, with no obvious damage or stains.

• Returns are free of charge and will be handled by our collection service.

2. Bases, Bed Frames, and Furniture – 14-day period

• Furniture products (bed bases, box springs, headboards, and other furniture)can be returned within 14calendardays of receiving the order.

• In order to return the product, it must bein its original condition, with no signs of use and with its original packaging intact.

• For logistical reasons, the cost of collection will be borne by the customer. The amount will depend on the location and dimensions of the product.

3. Accessories and Bedding – 30-day period

• Accessories, such as pillows, protectors, and bedding, may be returned within30 calendar days of receiving the order.

• To proceed with the return, these products must beunused and in their original sealed packaging.

• For hygiene reasons, returns of products that have been used or washed will not be accepted.

4. Return Process

If you wish to return a product, please follow these steps:

1. Contact our customer service teamvia[email / contact form] indicating the order number and the reason for the return.

2. We will provide youwith instructions for collecting or shipping the product, as well as the associated cost, if applicable.

3. Once we have received and verified the product in our warehouse, we will proceed with the refund within5 to 10 business days.

5. Exceptions and Refusal of Returns

Returns will not be accepted in the following cases:

• Products that show signs of use, dirt, stains, or damage caused by improper use.

• Customized or made-to-order products, except for manufacturing defects.

• Accessories or bedding that have been opened and used.

Likewise,Morfeoreserves the right to update, modify, or delete information contained on its Website, in its configuration and presentation, and in the conditions of access, at any time and without prior notice, without assuming any responsibility for doing so.

Intellectual Property

Morfeois the owner or licensee of the intellectual and industrial property rights applicable to the texts, graphic design, source code, and all other content on the Website protected under intellectual and industrial property laws. As a result,Morfeohas the exclusive right to exploit these rights in any form and, in particular, the rights of reproduction, distribution, public communication, and transformation, in accordance with Spanish intellectual and industrial property rights legislation.

Authorization granted tothe Userto access the Website does not imply any waiver, transfer, license, or total or partial assignment of intellectual or industrial property rights on the part ofMorfeo.

It is not permitted to delete, circumvent, or manipulate in any way the contents of theMorfeoWebsite. It is also prohibited to modify, copy, reuse, exploit, reproduce, publicly communicate, make second or subsequent publications, upload files, send by mail, transmit, use, process, or distribute in any way all or part of the content included on theMorfeoWebsite for public or commercial purposes without the express written authorization ofMorfeoor, where applicable, the owner of the corresponding rights.

Userswho share any type of content through the Website grantMorfeoa non-exclusive, free, worldwide license limited to the reproduction and public communication of said content through the provision of the Website's services.

For the purposes of Organic Law 15/1999 of December 13 on the Protection of Personal Data, the personal data of users who register on the Website are protected under Organic Law 15/1999 on the Protection of Personal Data (LOPD) and other related data protection regulations. In any case,Morfeoguarantees the confidentiality and security of Personal Data, having adopted the legally required security measures that reasonably ensure the protection of your personal data and prevent its loss, misuse, alteration, unauthorized processing, or access.

Independence of Clauses

If any clause in these Terms and Conditions is null and void or voidable, it shall be deemed not to have been included. Such a declaration of nullity shall not invalidate the rest of the Terms and Conditions, which shall remain in force and effect between the parties.

If any clause of these Terms and Conditions is declared, in whole or in part, null and void or ineffective, such nullity or ineffectiveness shall only affect that provision or the part thereof that is null and void or ineffective, and the Terms and Conditions shall remain in force in all other respects, with the provision or part thereof that is affected being deemed not to have been included.

Applicable Legislation

These Terms and Conditions shall be governed by Spanish law, which shall apply in matters not covered by these Terms and Conditions in relation to interpretation, validity, and enforcement. Likewise, both parties submit to the Courts and Tribunals of Madrid, expressly waiving any other jurisdiction.
